No More ENDO! Labor Dept. Orders Jollibee to Regularize 7,000 Employees!

Jollibee is under fire from the Department of Labor and Employment (DOLE) due to ENDO (end of contract). DOLE has ordered Jollibee to regularize almost 7,000 of its contractual employees. The fastfood giant’s labor contractors have also been ordered to return millions of pesos of ‘illegally collected payments”!

No more illegal labor contractualization! No more ENDO! That’s the message of DOLE to Jollibee as it ordered the biggest fastfood company in the country to regularize 6,482 workers supplied by its two labor contractors.  

Burger King was also ordered to regularize 704 employees. Jollibee holds the master franchise of Burger King in the Philippines.

And the figure may increase further because the order only came from DOLE’s NCR office. What about the other Jollibee stores under the jurisdiction of other DOLE offices in the country?

Aside from the regularization order, DOLE likewise gave the following demands to Jollibee and several contractors:

  • Jollibee Foods is ordered to “refund illegally collected payments to 426 affected workers in the amount of P15,432,305.00 for Coop Share, Coop Christmas Party Paluwagan Fund, and Coop Savings Fund”;
  • Jollibee Foods contractor Citiwide Basic Commodities and Manpower Services Inc. is ordered to refund P1,853,578.00 to 40 workers for cash bond for motorcycle rentals, and unpaid service incentive leaves and holiday pay;
  • Another Jollibee contractor, Generation One Resource Service and Multi-Purpose Cooperative, ordered to refund 287 employees the total amount of P1,180,363.15 for share capital, cooperative shares, membership fees, damayan fund, and unpaid holiday pay;

Aside from the above, collected coop shares and uniform costs (P440,300.00) were also ordered refunded to 24 employees by Integral Care Formation Service Cooperative, while P464,012.00 was ordered returned to 47 workers of Toptrend Service Corp. for motorcycle rentals.

This is a big blow to Jollibee, one of the biggest companies in the Philippines, but also one of the biggest employers of contractual employees. With the Duterte administration seemingly determined to fulfill its promise to end ENDO, it fired the opening salvo on Jollibee.

But, it seems, other fastfood giants are also on target. DOLE said that aside from Jollibee, establishment inspection of McDonald’s and Kentucky Fried Chicken (KFC) restaurants. DOLE’s Quezon City office has also scheduled an inspection of Mang Inasal and Chowking, also owned by Jollibee.

But what about SM, probably the biggest employer of contractuals? Will Henry Sy’s SM Supermalls escape unscathed?
