In a decision handed down by Branch 89 of the Quezon City Regional Trial Court (RTC), Judge Cecilyn Villavert sentenced Ma. Theresa Torres to 2 to 6 years in prison, as well as demanding her to pay damages, for the death of Juan Carlo Miguel Alcantara, aka Amiel Alcanatara, and the injury suffered by his yaya.

The accident occurred on February 24, 2009 at around 4:30 PM at the Ateneo de Manila University parking lot. Torres and her daughter were inside their double-parked van while the driver was fetching her son on foot.

In her testimony in court, she said that she heard a car horns and thought they were blocking the way. She then went to the driver’s seat to move the van. As the vehicle moved forward, it hit Amiel Alcantara and his yaya who were crossing the street.

Witnesses said the van was traveling at around 40 to 60 kph when it hit the two victims before coming to a full stop after slamming into two cars. Amiel was pinned down by the van’s wheels and died in the arms of their driver as he was being rushed to hospital.

Ma. Theresa Torres was later overheard telling ADMU guards that she stepped on the accelerator instead of the breaks.

In interviews weeks after the incident, the Alcantaras said they still could not find it in themselves to forgive Torres, who reportedly never approached the victims family ask for forgiveness. But, according to a source of the Inquirer now, Amiel’s parents had already forgiven Torres who gerself is also a parent.

The Inquirer further reports that Ma. Theresa Torres immediately approached the Alcantaras after the verdict was read and all of them wept.
